Acceptance of Terms
Agreement
By accessing or using MEL360 ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform.
Eligibility
You must be at least 18 years of age and have the legal authority to enter into these terms on behalf of yourself or your organization. By using MEL360, you represent that you meet these eligibility requirements.
Modifications
MEL360 reserves the right to modify these Terms of Service at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after modifications constitutes acceptance of the updated terms.
Service Description
Platform Overview
MEL360 provides a cloud-based monitoring, evaluation, and learning platform designed for NGOs, development organizations, and research institutions. Our services include data collection tools, indicator tracking, dashboard analytics, report generation, and collaborative project management features.
Service Availability
We strive to maintain 99.9% uptime for the Platform. However, we do not guarantee uninterrupted access and may temporarily suspend services for maintenance, updates, or unforeseen technical issues. We will provide advance notice of planned maintenance whenever possible.
User Responsibilities
Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify MEL360 immediately of any unauthorized use of your account. You are liable for all activities that occur under your account.
Acceptable Use
You agree to use MEL360 only for lawful purposes consistent with monitoring, evaluation, and learning activities. You shall not use the Platform to store or transmit malicious code, infringe on intellectual property rights, or engage in any activity that disrupts the Platform or its services.
Data Accuracy
You are responsible for the accuracy, quality, and legality of the data you upload to MEL360. You must ensure that your data collection activities comply with applicable local and international laws, including data protection regulations and informed consent requirements.
Pricing & Payment
Subscription Plans
MEL360 offers various subscription plans with different feature sets and usage limits. Pricing details are available on our website. All prices are quoted in U.S. dollars unless otherwise specified.
Billing
Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan. Payment is due upon invoice. Late payments may result in service suspension after a 15-day grace period.
Refunds
Annual subscriptions may be cancelled within 30 days of initial purchase for a full refund. Monthly subscriptions can be cancelled at any time but are non-refundable for the current billing period. Custom enterprise agreements may have different refund terms.
Intellectual Property
Platform Ownership
MEL360, including its design, features, source code, documentation, and branding, is the exclusive property of MEL360 and its licensors. These Terms do not grant you any rights to use MEL360's trademarks, logos, or branding without prior written consent.
Your Data
You retain all ownership rights to the data you upload to MEL360. By using the Platform, you grant MEL360 a limited, non-exclusive license to process your data solely for the purpose of providing the services you have requested.
Feedback
Any feedback, suggestions, or ideas you provide about MEL360 may be used by us without obligation to you. We may incorporate such feedback into the Platform without compensation or attribution.
Termination
By You
You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, you will retain access until the end of your current billing period.
By MEL360
We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activities that harm the Platform or other users. We will provide reasonable notice before termination except in cases of severe violations.
Data After Termination
Upon account termination, you may request an export of your data within 30 days. After this period, we will delete your data from our active systems within 90 days. Some data may be retained in backups for up to 12 months.
Limitation of Liability
Disclaimer
MEL360 is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be error-free, secure, or available at all times.
Liability Cap
To the maximum extent permitted by law, MEL360's total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to MEL360 in the 12 months preceding the claim.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
